Data collected

The site has no user accounts, no online payment and no embedded forms. Apart from the audience measurement described below, which is only enabled with your agreement, browsing the site involves no collection of data.

When you submit a request (information about a work, book order, newsletter subscription, proposing a work), you are redirected to a form hosted by our customer relationship management tool. The data collected is the data you provide: identity, contact details (email, phone), the content of your message and, where applicable, the reference of the work concerned.

You may also contact us directly by email or through social media; the data transmitted is then the data contained in your message.

Purposes and legal bases

Your data is processed to: answer your requests and follow up on them (pre-contractual measures and the gallery’s legitimate interest); send you the newsletter if you have subscribed (consent, withdrawable at any time via the unsubscribe link); manage the client relationship and follow up on acquisitions (performance of the contract); measure the site’s audience in order to improve its content and navigation (consent, withdrawable at any time from this page).

Recipients and processors

Data is intended exclusively for the Galerie Marcelpoil team. It is processed through our technical providers: HubSpot (forms and customer relationship management), Brevo (newsletter delivery), DigitalOcean (site hosting) and, if you have consented, Google Ireland Limited (Google Analytics audience measurement). Some of these providers may process data outside the European Union; such transfers are covered by appropriate safeguards (standard contractual clauses of the European Commission, EU–US Data Privacy Framework).

No data is sold or shared with third parties for commercial purposes.

Retention periods

Prospect and contact data is kept for a maximum of 3 years after your last contact. Newsletter data is kept until you unsubscribe. Data relating to an acquisition is kept for the applicable legal periods (accounting obligations and art market registers). Audience-measurement data is kept for a maximum of 14 months.

Cookies and trackers

The site uses Google Analytics 4 to measure its audience in aggregate form: pages viewed, traffic sources, device type. These cookies are only set once you have accepted them. Until you accept, Google’s script is not loaded and no data is sent to Google.

Cookies concerned: “_ga” and “_ga_” followed by the measurement ID, set by Google Analytics to distinguish visitors — lifetime 13 months. No advertising cookie is set and no data is used for profiling or targeted advertising.

A language preference (French / English) is stored locally in your browser (localStorage): it is strictly necessary for the site to work, requires no consent and is not transmitted to anyone.

Forms hosted by our providers (notably HubSpot) are subject to their own privacy policies, available on their pages.

Your choice, whether acceptance or refusal, is stored locally in your browser for 6 months; you are then asked again. You can change it at any time:

In accordance with the General Data Protection Regulation (GDPR) and French data protection law, you have the right to access, rectify, erase, object to, restrict and port your data. To exercise these rights, write to us at [email protected].

If you believe your rights are not being respected, you may lodge a complaint with the French data protection authority, the CNIL (cnil.fr).
